Business conditions

1. General provisions and definitions


1.1 These General Terms and Conditions (hereinafter referred to as "GTC") apply to business relations between the Buyer and Regidis s.r.o., with registered office at 157/45 M.R. Štefánika Street, 017 01 Považská Bystrica, ID No. 36 353 302 (hereinafter referred to as "Operator" or "Seller") concluded through the system of the electronic department store www.mymyherb.com (hereinafter referred to as "System").

 

1.2 The GTC regulate the rights and obligations of the parties to the purchase contract concluded remotely via the www.mymyherb.com server between the Seller and the Buyer.

 

1.3 The rights and obligations of the parties to the purchase contract are governed by the legal regulation of the purchase contract pursuant to Sections 588 et seq. in conjunction with Sections 612 et seq. of Act No. 40/1964 Coll., Civil Code.

 

1.4 The Buyer shall be understood as a natural or legal person registered in the system who has sent an electronic order processed by the shop system after self-authorisation.

 

1.5 Electronic order means an electronic form containing information about the Buyer, a list of ordered goods from the e-commerce offer and the price of these goods, processed by the shop system or an e-mail sent to the Seller's address.

 

2. Order


2.1 The validity of an electronic order is subject to the true and complete completion of all data and details required by the registration form, including telephone contact.


2.2 All electronic orders received shall be deemed to be a draft contract and shall be considered binding.

 

2.3 The contract of sale, on the basis of which the sale of goods by the Seller to the Buyer is made, is formed on the basis of a binding order confirmation in the system. An order (or part thereof) confirmed by the Seller by e-mail is considered binding for both parties, unless there is a breach of the terms and conditions agreed at the time of confirmation, in which case the relationship between the Customer and Regidis Ltd. is also established at the same time.


2.4 The essential terms and conditions are mainly the content of the order (exact specification of the goods and their number), the price for the goods and transport, the method of delivery, the method of payment for the goods.

 

3. Order cancellation

 

3.1 Cancellation of the order by the buyer
The Buyer has the right to cancel the order without giving any reason at any time before its binding confirmation by the Seller. After the binding confirmation of the order only if the Seller fails to meet the agreed delivery conditions. In the event of cancellation of a confirmed order, the Buyer is obliged to pay the Seller for the damage caused by this action. The Seller shall be entitled to claim damages mainly in the case of the purchase of goods "to order", which had to be procured at the customer's request or in the event that demonstrable costs have already been incurred in connection with the securing of the goods. The cancellation fee may be up to 50% of the total price of the goods.


3.2 Cancellation of an order by the Seller

The Seller reserves the right to cancel an order or part of an order in the following cases:

* in the case of a COD order, the order could not be confirmed in a binding manner (wrong phone number, unavailable, not responding to emails, etc.).
* if the buyer has not taken delivery of the goods in the past or has otherwise violated the terms and conditions
* the goods are no longer manufactured or delivered or the price of the supplier of the goods has changed significantly. In the event that this situation arises, the seller will contact the buyer immediately in order to agree on the next course of action. If the Buyer has already paid part or all of the purchase price, the amount will be transferred back to the Buyer's account or address within 15 calendar days.

 

4. Withdrawal from the contract of sale (mail order)


4.1 Withdrawal from the contract of sale by the buyer
The Buyer has the right, in accordance with the Act on Consumer Protection in Mail Order Sales No. 108/2000 Coll. to withdraw from the purchase contract within 7 working days of receipt of the goods. In case of exercising this right, the buyer is obliged to comply with the conditions and procedure specified in point 4.2. of the GTC.

 

4.2 How to proceed in case of withdrawal from the purchase contract
Since in the event of withdrawal the contract is cancelled from the outset, the Supplier shall return or refund to the Purchaser and the Purchaser shall reimburse the Supplier for all mutually accepted performance.
If the Customer chooses to withdraw from the contract within the time limit set out in clause 4.1, the Customer shall comply with the following conditions:

 

* contact us (see contact) with a cancellation request, stating the order number, first and last name, date of purchase and your account number or address for refund.
* if the buyer has already received and accepted the goods, he/she will send them back to our address listed in the contact section under the following conditions:
o the goods must be in their original undamaged packaging (with the protective film intact)
o the goods must not have been used
o the goods must be undamaged
o the goods must be complete (including package leaflet, etc.)
o send with proof of purchase - invoice

If all of the above conditions for returning the goods are met, we will send you the money for the goods by bank transfer to your account no later than 14 working days after the physical receipt of the goods.
The goods must be sent by registered post and insured, as we are not responsible for any loss en route to us. Cash on delivery will not be accepted.
If any of the above conditions are not met, cancellation of the order will not be accepted and the goods will be returned at the sender's expense.

 

5. Price conditions


5.1 The price of the products shall be the price inclusive of 19% VAT


5.2 The prices for postage and packing are set out in clause 6

6. Postage and packing


6.1 Regidis s.r.o. does not charge for packing.


6.2 The price of postage is inclusive of VAT and is determined from the final order amount after all discounts as follows:

 

6.3 No postage is charged for personal collection.


6.4 Postage and packing costs for deliveries to the territory of the member states of the European Union or other countries are determined individually on the basis of a written agreement (by email) between the Buyer and the Seller.

 

7. Terms and conditions and payment option for the goods


7.1 By a one-off transfer from the account to the bank account of Regidis Ltd. specified in the e-mail notification. In the case of payment by bank transfer, the buyer receives an extra discount of 1 Euro.

 

7.2 By payment on delivery upon receipt of the goods at the post office.

 

7.3 By cash at the company's registered office on the basis of the invoice and the issued cash receipt.

 

7.4 If the price for the delivered products is not paid in full, the Seller shall have the right to suspend further deliveries of the goods until the price has been paid.

 

8. Delivery terms


8.1 Deliveries of the subject of performance (ordered goods) shall be dispatched as soon as possible, subject to the availability of the products and the Seller's operational capabilities. The availability of the goods is indicated for each product.

 

8.2 Each customer is informed of any changes in the order status by email. He can check the status of the order by logging into the system.

 

8.3 Goods are delivered via Slovak Post to the address specified by the customer in the order. The shipment of goods always includes an invoice.

 

8.4 The goods are also available for personal collection at the registered office of Regidis s.r.o. by mutual agreement.

 

8.5 Title to the products shall pass to the purchaser upon receipt and payment of the purchase price.

 

8.6 The goods are delivered exclusively on the territory of the Slovak Republic.

 

8.7 Delivery of the goods to the territory of the member states of the European Union or other countries is subject to prior agreement and mutual written agreement between the Buyer and the Seller on the price for postage and packing and any other delivery conditions.

 

9. Warranty conditions and Complaints procedure


9.1 This complaint procedure applies to goods that were purchased from Regidis s.r.o. and whose claim was made within the warranty period of 24 months from the date of purchase of the goods.

 

9.2 For each product purchased from Regidis s.r.o. when it is delivered to the buyer, an invoice (sales document) is attached, which also serves as a warranty document.

 

9.3 When taking over the goods, the buyer is obliged to check the following:

* whether it is a product that was ordered (if it is a product that was not ordered, do not unpack or open the product, otherwise it will not be possible to exchange it)
* whether the product is in intact condition, i.e. whether it has an obvious defect
* whether all its individual parts work

The warranty does not apply to product defects caused by improper use, storage or damage to the product by the buyer. The packaging and contents of the product must not be mechanically damaged (mechanical damage means damage to the product that could not have arisen from normal use of the product for the purpose for which it was manufactured).

10. Liability for errors on www.mymyherb.com


10.1 The company Regidis s.r.o. points out that the information provided on www.mymyherb.com is partly taken from third parties, may contain inaccuracies and may be updated without prior notice.


10.2 Regidis s.r.o. may change the products and services described on its pages at any time without prior notice and does not guarantee the material accuracy of their content.


10.3. The company Regidis s.r.o. shall not be liable to another party for direct, indirect or special damages caused by the use of information from its own or linked websites.

 

11. Protection of personal data


11.1 The company Regidis s.r.o. is fully governed by Act no. 428/2002 Coll. on the protection of personal data in information systems. Our company respects your privacy. However, in order to offer you valuable services, we need to know some of your personal data. We protect this data from misuse and guarantee that we will never provide your contact information and data about your purchases to a third party.


11.2 By using this online store, you agree to the collection and use of information about you and your purchases under the conditions set out above. By registering as a customer, requester for news (so-called newsletter), survey participant and other forms of registration, you automatically agree that you can be informed about news in our online store by e-mail or by phone. If you no longer want this information, you have the option to stop sending it at any time according to the procedure specified in each sent message.


11.3 Our online store reserves the right to withdraw from the security guarantee in the event of an attack on the server by an unknown perpetrator (hacker). Only in that case, the above-mentioned data handling rules do not apply.
